Welcome to Remerge! These Terms of Service (“Terms”) govern your access to and use of the Remerge mobile application, website, related services, and any other content, functionality, or features offered (collectively, the “Services”). By accessing or using Remerge, you agree to be bound by these Terms and our Privacy Policy.

Community Guidelines

Remerge is built to help friends and groups capture authentic video moments together. To keep our community safe and enjoyable for everyone, we ask that you follow these Community Guidelines. Failure to follow them may result in warnings, suspension, or permanent account termination.

Be Respectful: Treat others with kindness. Do not harass, bully, or target others with hate speech.
No Nudity or Sexual Content: Explicit sexual material, pornography, and sexually exploitative content (especially involving minors) are strictly prohibited.
No Violence or Gore: Do not share excessively graphic, violent, or shocking content, including depictions of physical harm.
Protect Minors: Do not post or solicit content involving children in any harmful or sexual context. Underage accounts will be removed.
Keep Groups Safe: Content shared in private groups must still follow these rules. Being in a private group does not exempt you from moderation.
Respect Intellectual Property: Share only videos and media you own or have the right to use. Do not infringe copyrights or trademarks.
No Illegal Activity: Do not use Remerge to promote or coordinate criminal activity, terrorism, or drug use.
No Spam or Scams: Do not use Remerge for unsolicited advertising, phishing, or fraudulent schemes.
Report Violations: Use in-app reporting tools to notify us of harmful or suspicious activity.
Think Before You Share: Remember that your content represents you and may be shared with others in your groups.

Eligibility

You must be at least 13 years of age to use the Services. Children under 13 are strictly prohibited from using Remerge. We comply with COPPA and GDPR requirements to protect minors. By using the Services, you represent and warrant that you meet these requirements.
We must not have previously disabled your account for violation of law or any of our policies.
You must not be a convicted sex offender.

Account Registration and Security

You must provide accurate and complete information when creating an account. You are solely responsible for safeguarding your login credentials and for all activities under your account.
Remerge reserves the right to suspend, disable, or delete accounts that violate these Terms, including suspected fraudulent or abusive activity.
You may not create an account on behalf of another person, entity, or organization without proper authorization.

User Conduct and Prohibited Uses

By using Remerge, you agree not to:

Post or share nudity, sexual content, or sexually exploitative material.
Share violent, hateful, harassing, or threatening content.
Engage in bullying, intimidation, or abusive behavior.
Post illegal content, including content promoting terrorism, drugs, or criminal activity.
Infringe on intellectual property or proprietary rights of others.
Use the Services for spam, scams, or unauthorized advertising.
Circumvent or attempt to exploit vulnerabilities in our systems.
Misrepresent your identity or impersonate others.

User Content and Licensing

You retain ownership of the videos, photos, and content you upload to Remerge. However, by using the Services, you grant Remerge a worldwide, royalty-free, transferable, sub-licensable, non-exclusive license to host, store, process, display, reproduce, adapt, publish, and share your content as necessary to operate and improve the Services.
You represent and warrant that you have the rights to the content you upload.
Remerge reserves the right to remove or restrict content that violates these Terms, our Privacy Policy, or applicable law.

Safety, Reporting, and Enforcement

Remerge is committed to creating a safe environment. Users can report content or accounts that violate our policies through in-app tools or by contacting support.
We maintain a 'three-strike' system for most violations, with immediate permanent suspension for severe violations such as child sexual abuse material (CSAM).
Remerge cooperates with law enforcement and regulatory authorities where required by law.

Termination and Account Deletion

Remerge may suspend or terminate your account at any time for violation of these Terms.
You may delete your account at any time within the app settings. Account deletion typically takes 15 days, after which all data is permanently erased unless legal obligations require retention.

Intellectual Property

All trademarks, logos, software, and branding associated with Remerge are the property of Hastech Media, LLC, and may not be copied, imitated, or used without prior written consent.
You agree not to reverse engineer, decompile, or otherwise attempt to derive source code from the Services.

App Store and Platform Compliance

By downloading Remerge from Apple’s App Store or Google Play, you also agree to comply with their respective policies and terms.
Remerge is solely responsible for the Services, not Apple or Google. Both Apple and Google are third-party beneficiaries of these Terms.

Disclaimers and Limitation of Liability

Remerge provides the Services 'as is' without warranties of any kind.
To the maximum extent permitted by law, Remerge disclaims liability for damages resulting from your use of the Services, including but not limited to data loss, content misuse, or interactions with other users.
Nothing in these Terms excludes liability for death, personal injury, fraud, or willful misconduct.

Dispute Resolution

You agree that disputes will first be attempted to be resolved informally by contacting Remerge support.
Any unresolved disputes will be resolved by binding arbitration under the rules of the American Arbitration Association.
Class action lawsuits or class-wide arbitration are not permitted.

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Texas, United States of America.
Any disputes not subject to arbitration shall be resolved in the courts of Travis County, Texas, USA.

Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain valid.
These Terms constitute the entire agreement between you and Remerge/Hastech Media, LLC.
We may update these Terms periodically. Updates will take effect 30 days after notification, unless otherwise required by law.

Content Moderation & Enforcement

Remerge employs both automated tools and human moderators to review content that may violate our Terms or Community Guidelines.
Automated detection may flag content involving nudity, violence, hate speech, or other policy violations. Flagged content may be reviewed manually by a moderator.
Users may appeal enforcement actions by contacting support@remergeapp.com. Appeals will be reviewed within 14 business days.
Remerge reserves the right to permanently ban repeat offenders or users who engage in egregious violations without prior warning.

Third-Party Services & Links

The Services may contain links to third-party websites, services, or content not owned or controlled by Remerge.
Remerge is not responsible for the practices, policies, or content of third parties.
If you choose to access third-party services through Remerge, you do so at your own risk and agree that their terms and policies will apply.

In-App Purchases & Subscriptions

Remerge may offer premium features or subscriptions that can be purchased through Apple’s App Store or Google Play.
Purchases are processed by Apple or Google, and their terms govern refunds, billing disputes, and subscription management.
Subscriptions may auto-renew unless canceled in accordance with the respective app store policies.
Remerge is not responsible for errors in payment processing or disputes handled by third-party platforms.

Data & Privacy Obligations

By using Remerge, you agree to the collection, use, and processing of your information as described in our Privacy Policy.
You agree not to misuse data you access through the Services, including personal information of other users.
You may not attempt to scrape, mine, or extract data from the Services without authorization.

Service Availability & Updates

Remerge does not guarantee uninterrupted or error-free access to the Services.
We may modify, suspend, or discontinue any feature or part of the Services without liability.
Remerge may provide updates or patches to maintain or improve functionality, which you agree to install.

Indemnification

You agree to defend, indemnify, and hold harmless Hastech Media, LLC, its affiliates, officers, employees, and partners from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney’s fees) arising from:

Your use of the Services.
Your violation of these Terms.
Your violation of any third-party rights, including intellectual property or privacy rights.

This indemnification obligation will survive the termination of these Terms and your use of the Services.

Force Majeure

Remerge shall not be held liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, pandemics, labor disputes, government actions, or internet failures.

Entire Agreement & Waiver

These Terms, along with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Remerge/Hastech Media, LLC.
No waiver of any provision shall be considered a further or continuing waiver unless explicitly stated in writing.
